5.1.2. Penalties for Violations of Permit Conditions
Violations. The Act provides that any person who violates the Act, Utah waste water rules, or conditions of a permit issued under the Act is subject to a fine of $10,000 per day. Willful or Gross Negligence. The act provides that any person who discharges a pollutant to waters of the state as a result of criminal negligence or who intentionally discharges is criminally liable and is subject to imprisonment and a fine of up to $50,000 per day. Utah Code Ann. $19-5-11. False Statements. The Act provides that any person who knowingly makes any false material statement, representation, or certification in any application, record, report, plan, or other document filed or required to be maintained under the Act, the rules, or the Permit, or who knowingly falsifies, tampers with, or renders inaccurate, any monitoring device or method required to be maintained under the Act shall upon conviction, be punished by a fine of not more than $10,000 or by imprisonment for 6 months, or by both.
